DWC Proposes MQR Audit Plan for 2025
|
The Division of Workers' Compensation (DWC) has proposed the 2025 Medical Quality Review Annual Audit Plan, outlining audit priorities for the year. The proposed plan includes an audit of designated doctor reports to assess quality and the necessity of any additional testing ordered. The Medical Quality Review Panel (MQRP) will also support the 2025 Health Care Provider Performance-Based Oversight Assessment to ensure appropriate documentation regarding injured employees' ability to return to work. Additionally, MQRP members will conduct a study on adopting an updated version of the AMA Guides to the Evaluation of Permanent Impairment, based on recent revisions to the musculoskeletal chapters. Any adjustments to the plan will require approval from the commissioner of workers’ compensation.
DWC is seeking input on the proposed plan, specifically on "Section 1: Review Categories." Comments will be accepted until Nov. 22. If you have feedback you would like ICT to consider submitting, email Angie Cervantes by Nov. 17.

Deadly truck crash foreshadows fight
between business, safety at Capitol
|
In October 2018, Jay Rosenberg lost his wife, Leslie, and daughter, Sophie, in a tragic accident involving a semi-truck, which led him to advocate against Texas House Bill 19. The accident occurred when a truck driver failed to yield, causing their vehicle to go under the trailer, killing both instantly.
Key Points:
- Sophie, a Texas A&M student, died in a car accident caused by a truck driver who didn’t yield.
- Rosenberg testified against HB 19, fearing it would prevent accountability in similar crashes.
- HB 19 divides lawsuits into two phases, complicating efforts to hold companies accountable.
- Advocates argue HB 19 protects businesses, while opponents say it delays justice for victims.
- Texas fatal trucking crashes are rising, leading some to push for further lawsuit reforms.

Car insurance costs surge as extreme weather increases risk
|
Auto insurance rates are increasing across the U.S., driven by extreme weather events, inflation, and rising accident rates. These factors, along with secondary perils like flash floods and heavy rainstorms, are pressuring insurers to raise premiums. Experts warn of the increased risk of flood-damaged vehicles being fraudulently sold, putting unsuspecting buyers at risk.
Key Points:
- Auto insurance premiums may rise by up to 22% by the end of the year.
- Extreme weather events are driving significant increases in vehicle damage, leading to higher insurance costs.
- Secondary perils, such as flash floods, are a major contributor to rising insurance premiums.
- Fraudulent sales of flood-damaged vehicles are increasing, posing safety risks to buyers.
- The rising cost of insurance may create financial challenges for families as vehicle damage from climate-related events becomes more common.

Call KENS: Veteran couldn't get his USAA
claim settled without his truck becoming
salvage
|
Retired veteran James Rhoades' truck was hit from behind, resulting in minor damage he hoped to repair. After initially declaring the truck a "total loss" and planning to salvage it, USAA reversed its decision when KENS 5 intervened. Rich Johnson, ICT's Communications Director, explained to KENS 5 that insurance companies can choose when to declare a vehicle totaled, but there are no set rules, which was a key factor in the case.
Key Points:
- Rhoades initially wanted only a repair for the minor damage to his truck, which he maintains carefully.
- USAA deemed the truck a "total loss" and intended to classify it as a salvage vehicle, creating complications for Rhoades.
- Rich Johnson, ICT’s Communications Director, explained to KENS 5 that each insurance company has its own guidelines for totaling vehicles.
- KENS 5 discovered that the repair cost didn’t meet Texas' statutory threshold for a salvage vehicle, prompting USAA to reverse its decision.
- Rhoades expressed gratitude to KENS 5, whose investigation allowed him to keep his truck without further legal and inspection issues.
